An application for divorce can only be filed 12 months following separation and where there is no possibility of the parties reconciling. These conditions must be met before an application for divorce can be made, unlike property and children's issues which can be sorted out as soon as the parties separate.
It is very important to ensure that property issues are sorted out within 12 months of the Court finalising the divorce, otherwise the right to claim certain property from the marriage may be lost. The deadline for sorting out property issues in a de facto relationship, is 2 years from the date of separation.
